History of Golf Course Law and Liability

Is there another sport where the past is so richly interwoven with the present? We honor Jones’ Grand Slam and Nicklaus’ record for major victories. We entertain debates about the origin of golf and the location of the first courses and clubs. Our Opens are played upon hallowed grounds laid out by the likes of Old Tom Morris, Charles Blair Macdonald, and Dr. Alister Mackenzie. We cherish the writings of Bernard Darwin and Herbert Warren Wind.

Should it come as any surprise that there is an interesting scattering of evidence that law and liability dates back to its earliest times? Here, I’m going to offer out the historic references I have come across in my readings, writings and research.
